Legal Partner Agreement
Read and accept each clause individually before proceeding. This is a legally binding agreement under Indian law.
By registering as a CIBIL Repair Authorized Partner, you enter into a legally binding agreement governed by the Indian Contract Act, 1872. You agree to:
- Represent CIBIL Repair in a professional, ethical, and lawful manner at all times.
- Not make false, misleading, or exaggerated claims about our services.
- Comply with all applicable central and state laws, RBI guidelines while conducting business.
- Maintain complete confidentiality of all client information obtained through the partnership.
- Obtain prior written approval for all marketing materials bearing the CIBIL Repair brand.
- Not misrepresent yourself as an employee, agent, or officer of CIBIL Repair.
Partners earn commission on successful client referrals. Commission is payable ONLY after (a) client payment received in full, (b) service is completed, (c) client has not invoked the money-back guarantee. Payouts are processed on the 7th of every month via NEFT/IMPS. TDS deducted as per Indian tax laws.
- Individual Partners: Up to 15% per conversion
- DSA / Agency Partners: Up to 20% + volume bonuses
- Corporate Partners: Custom structure, case-by-case
- Platinum/Diamond Partners: Up to 50% on high volumes
As a partner handling client personal and financial data, you are bound by the IT Act, 2000 and DPDP Act 2023. You agree to:
- Handle all client data with the highest standard of confidentiality.
- Never share, sell, or transfer any client data to third parties without express written consent.
- Immediately notify CIBIL Repair of any suspected data breach within 24 hours.
- Delete all client data from personal devices upon termination of partnership.
Violation: Any breach may lead to criminal prosecution under Section 72A of the IT Act.
The following activities are strictly prohibited and will result in immediate termination:
- Deceptive Marketing: Misleading clients about outcomes, timelines, or guarantees beyond what is officially stated.
- Impersonation: Representing yourself as an employee or officer of CIBIL Repair.
- Brand Misuse: Modifying or using CIBIL Repair's logo/trademarks without written permission.
- Competitor Promotion: Simultaneously promoting competing credit repair services.
- Cash Collection: Collecting service fees from clients directly. All payments through official channels only.
CIBIL Repair may terminate this partnership immediately, with or without cause, by written notice via email. Immediate termination may occur in case of fraud, data breach, or brand disrepute.
Upon termination, you must (a) immediately cease all referral activities, (b) remove all CIBIL Repair branding, (c) return or destroy all confidential information, (d) not approach CIBIL Repair clients directly for 12 months.
Commissions for conversions completed before termination will be paid per the regular schedule, subject to no fraud investigation.
CIBIL Repair's total liability shall not exceed the total commission paid in the preceding 3 months. CIBIL Repair shall not be liable for indirect or consequential damages arising from delays, regulatory changes, or bureau actions.
Indemnification: You agree to indemnify and hold harmless CIBIL Repair, its directors, employees, and agents from any claims arising from your actions or breaches of this agreement.
This partnership agreement is valid for 12 months from acceptance and auto-renews annually unless either party provides 30-day written notice of non-renewal.
CIBIL Repair may amend terms at any time by providing 15 days' notice. Continued participation after the notice period constitutes acceptance.
Governing Law: Laws of India. Disputes subject to exclusive jurisdiction of courts in Delhi, India. Disputes first attempted through mutual negotiation, then arbitration under the Arbitration and Conciliation Act, 1996.
You acknowledge that:
- All information provided is true, accurate, and complete. False information results in immediate disqualification.
- You consent to CIBIL Repair conducting background verification including PAN validation and Aadhaar KYC.
- You confirm you are 18 years or older and legally competent to enter into this agreement.
- You are not subject to any criminal proceedings, regulatory action, or insolvency proceedings.
- You agree to notify CIBIL Repair of any material change in your circumstances that may affect this partnership.
