Legal Consent Agreement
You must read and individually accept each clause before proceeding to the registration form. This is a legally binding agreement.
By registering as a CIBIL Repair Authorized Partner, you enter into a legally binding agreement governed by the Indian Contract Act, 1872. You agree to:
- Represent CIBIL Repair in a professional, ethical, and lawful manner at all times.
- Not make false, misleading, or exaggerated claims about our services to clients or prospects.
- Comply with all applicable central and state laws, regulations, and RBI guidelines while conducting business.
- Maintain complete confidentiality of all client information obtained through the partnership.
- Obtain prior written approval for all marketing materials bearing the CIBIL Repair brand.
- Not misrepresent yourself as an employee, agent, or officer of CIBIL Repair.
Partners earn commission on successful client referrals based on the following structure:
- Individual Partners: Up to 15% commission per successful client conversion.
- DSA / Agency Partners: Up to 20% commission with volume bonuses applicable.
- Corporate Partners: Custom commission structure negotiated case-by-case.
Payment Conditions: Commission is payable ONLY after (a) client payment is received in full, (b) the service is completed, and (c) the client does not invoke the money-back guarantee. Payouts are processed on the 7th of every month for the previous month's conversions via NEFT/IMPS to the registered bank account. TDS will be deducted as per applicable Indian tax laws.
As a partner handling client personal and financial data, you are bound by the Information Technology Act, 2000 and the IT (Amendment) Act, 2008. You agree to:
- Handle all client personal, financial, and credit data with the highest standard of confidentiality.
- Never share, sell, or transfer any client data to third parties without express written consent from CIBIL Repair.
- Comply fully with CIBIL Repair's Privacy Policy and applicable data protection regulations.
- Immediately notify CIBIL Repair of any suspected data breach or unauthorized access within 24 hours.
- Delete all client data from personal devices upon termination of partnership.
Violation Consequence: Any breach of data confidentiality will result in immediate termination and may lead to criminal prosecution under Section 72A of the IT Act.
As a CIBIL Repair partner, the following activities are strictly prohibited and will result in immediate termination and potential legal action:
- Deceptive Marketing: Misleading potential clients about service outcomes, timelines, or guarantees beyond what is officially stated.
- Unsolicited Communications: Spamming or sending unsolicited bulk messages to potential clients via any channel.
- Impersonation: Representing yourself as an employee, officer, or official of CIBIL Repair.
- Brand Misuse: Modifying, altering, or using CIBIL Repair's logo, brand materials, or trademarks without written permission.
- Competitor Promotion: Simultaneously promoting or referring clients to competing credit repair services.
- Cash Collection: Collecting service fees from clients directly. All payments must go through CIBIL Repair's official channels.
- False Promises: Guaranteeing specific credit score outcomes that are beyond what CIBIL Repair officially offers.
Termination by CIBIL Repair: CIBIL Repair reserves the right to terminate this partnership immediately, with or without cause, by providing written notice via email or registered post. Immediate termination (without notice) may occur in case of fraud, data breach, violation of prohibited activities, or bringing the brand into disrepute.
Termination by Partner: You may exit the partnership by providing 30 days written notice to contact@cibilrepair.in.
Post-Termination Obligations: Upon termination, you must (a) immediately cease all marketing and referral activities, (b) remove all CIBIL Repair branding from your materials, (c) return or destroy all confidential information, and (d) not approach any CIBIL Repair clients directly for 12 months.
Pending Commissions: Commissions for conversions completed prior to termination date will be paid per the regular payment schedule, subject to no fraud investigation.
CIBIL Repair's total liability to you under this agreement shall not exceed the total commission paid to you in the preceding 3 calendar months. CIBIL Repair shall not be liable for any indirect, incidental, special, or consequential damages arising from delays in service delivery, changes in government regulations, actions of credit bureaus, or claims made by your referred clients against you personally.
Indemnification: You agree to indemnify and hold harmless CIBIL Repair, its directors, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from your actions, representations, or breaches of this agreement.
Duration: This partnership agreement is valid for 12 months from the date of acceptance and auto-renews annually unless either party provides 30-day written notice of non-renewal.
Amendments: CIBIL Repair may amend the terms of this agreement at any time by providing 15 days' notice. Your continued participation after the notice period constitutes acceptance of the amended terms.
Governing Law & Dispute Resolution: This agreement shall be governed by the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of courts in Delhi, India. Disputes shall first be attempted to be resolved through mutual negotiation, and if unresolved within 30 days, through arbitration under the Arbitration and Conciliation Act, 1996.
As a CIBIL Repair partner, you acknowledge that:
- All information provided in this application is true, accurate, and complete. Any false information will result in immediate disqualification.
- You consent to CIBIL Repair conducting background verification including PAN validation, Aadhaar KYC, and GST registration verification (if applicable).
- You authorize CIBIL Repair to verify your bank account details through the provided documents.
- You confirm you are 18 years or older and legally competent to enter into this agreement.
- You are not currently subject to any criminal proceedings, regulatory action, or insolvency proceedings.
- You agree to promptly notify CIBIL Repair of any material change in your personal or business circumstances that may affect this partnership.
PMLA Compliance: You confirm awareness of the Prevention of Money Laundering Act, 2002, and agree to never facilitate or participate in any money laundering activities through this partnership.
